Terms & Conditions of Accepting Advertising

IMPORTANT NOTICE: You must carefully read and then agree to the terms and conditions set out below before accessing and using the site. If you do not wish to be bound by these terms and conditions, you may not access or use the site. Any advertising booking/s made either via this website or via any other media, i.e. telephone, paper order confirmation or personally at our office, it will be assumed you have agreed to the terms and conditions.

The Terms and Conditions form part of an agreement between you, the end-user, and ourselves and sets out the conditions under which you may access the information, products, services and advertisements (the "Material") available through the Site. By accessing, viewing or using the Material on the Site you have indicated to us that you both understand and agree to be bound by these Terms and Conditions.

You acknowledge that:
  • the contributions to the website and its community forums, reader comments and blogs (if present), are the statements and views of the contributors and not of us or any of our connected companies, directors, employees or shareholders;

  • it is your sole responsibility to check the accuracy of any facts and opinions given on this website before entering into any commitment based upon them;

  • we do not, as a matter of course, actively moderate, monitor or edit the contributions to the website and its community;

  • any third parties advertising on our websites, or external (or link) sites accessible via our websites, are not under our control and we are not responsible in any way for any of their contents or for any agreement you may enter into with a third party arising from your visit to our websites.
If we find your use of this site seriously inappropriate, offensive or disruptive, we may use information we have about you to stop such conduct, and this may include informing relevant third parties such as your employer, school, email provider or, in the case of any suspected unlawful activity, the police.

We do not warrant that this website, the server that supplies it or any other of our systems will be uninterrupted or free of errors, viruses or bugs and we shall not be liable if this site is inaccessible at any time. Access may be suspended temporarily without notice for technical reasons or for reasons over which we have no control.

We make no representations and give no warranties with regard to the quality, suitability, reliability, compatibility, accuracy, non-infringement or completeness of the contents of this website, and any implied warranties are excluded to the extent permitted by law.

1. All advertisements are subject to acceptance by the publisher. They must comply with current legislation, with the publisher's terms and with the British Code of Advertising Practice.

2. The advertiser warrants that advertisements meet with the necessary requirements in 1) above, and that they are in no way illegal, defamatory or an infringement of a third party's rights.

3. The advertiser shall indemnify the publisher and its staff and/or the Editor from and against any actions, proceedings, claims, demands, damages, losses, costs or expenses (including legal costs) which the publisher or editor may incur as a direct or indirect consequence of publishing any of the advertiser's advertisements/inserts.

4. The publisher shall not be liable for any loss or damage, consequential or otherwise, caused by error, late for any reason. If the error or omission is due to an act or default of the advertiser or its servants or agents the advertiser shall be liable to pay the full advertising rate due in respect of the advertisement or insert.

5. The publisher shall inform the advertiser of any change of advertising rates at least 30 days before an advertisement is due to be booked into a specific publication.

6. The advertiser has the right to cancel the advertisement up to 21 days before cut off date, which is usually the 5th of each month. If the advertiser cancels within 20 days of the cut off date the advertiser will be liable for the full advertising rate for that advertisement.

7. Artwork, film or copy for the advertisement must be supplied by the advertiser by the date specified by the publisher. Subsequent alterations to an advert will only be accepted by the publisher if the alterations do not jeopardise the publication date of the publication. Any costs met by the publisher in making alterations must be met by the advertiser, at a rate of £15 per hours work, (minimum of £15 Charge).

8. Any complaint concerning an advertisement must be received in writing by the publisher within 14 days of publication.

9. The advertiser shall be responsible for insuring all artwork or film etc. for the advertisement and the publisher cannot accept liability for any loss or damage. The publisher has the right to destroy any artwork/film etc. for an advertisement still in its possession six months after the date of publication.

10. The publisher publishes the rates for display and classified advertisements. These will not be varied unless in writing by the publisher.

11. Any advertisement asking for cash with order must be accompanied by a PPA Mail Order Protection Form completed by the advertisers or agent.

12. No proof for any advertisers advert will be sent to the advertiser unless requested by notification in writing by the advertiser.

13. No refund or repeat of an advertisement will be made for a misprint, error or omission unless the publisher considers that it detracts materially from the advert. In no circumstances will the publisher's total liability exceed the cost of a corrected advert.

14. The publisher, its staff and / or the Editor shall not be accountable for any specific date during the month for any print run or distribution of that months edition.

15. The e-edition/paper / magazine known as Across Kent, (either single or different area edition/s when produced or any supplements), will only be produced and distributed on the strict basis that enough advertising space and revenue has been generated during the issuing month and the publisher has the complete right to transfer any advert that has been booked, regardless to whether the invoice has been paid or not, to the following month/s if said revenue does not cover all costs for the production and distribution of that months edition. The minimum revenue required for the e-edition/paper / magazine to be produced and distributed in any one month is �3,500.

16. PAYMENT: For payments outside of our terms and conditions, (which are payment at time of booking or on acceptance of advert proof), a 10% surcharge may apply. The prices stated are for Pre-payment, i.e. prior to production only or on acceptance of proof. All advert prices will be subject to the current rate of VAT

17. INTEREST PAYMENT: Please be aware that late payment of invoices will incur interest at 11.5% under The Late Payment of Commercial Debts (interest) 1998 and may be passed to a debt recovery company for collection of payment and their charges may be added. Alternatively the company may instruct online proceedings for recovery of any outstanding invoice and an additional charge may be added.

18. BOOKINGS: If any bookings of 3, 6 or 12+ issues are cancelled prematurely before end of the term, the published advert/s will all become payable at the single month rate each for the appropriate size and an invoice will be raised and issued to the advertiser, for immediate payment due.

19. CHEQUES: Any dishonoured cheques will incur an additional charge of £25 on top of the original invoiced amount for both bank charges and inconvenience incurred by the publisher, (administration).

20. CREDIT / DEBIT CARDS: All payments by this method can be made either via our website through our SECURE merchant account with PayPal. PLEASE NOTE THAT NO PAYPAL ACCOUNT IS REQUIRED & NO ADDITIONAL CHARGE WILL BE MADE, (UNLESS FOR LATE PAYMENT AS DESCRIBED ABOVE) an email will be required, or by telephone booking.

21. NON PAYMENT OF INVOICE: All invoices not paid within 7 days from date of booking/invoice or from time of acceptance of advert proof, may be passed to a debt recovery agency who may possibly enforce legal action for the recovery of any outstanding money and may incur both their costs and any court costs plus any interest legally allowed to be claimed. Alternatively the company may instruct online proceedings for recovery of any outstanding invoice and an additional charge may be added.
